Under the prerequisite that we act as Controller, this Privacy Policy applies when you:

When we refer to Ingenius Technologies and Consutling (ITC), we mean the entity is responsible for the means and purposes of the processing and therefore acts as the Controller of your Personal Data.

  • Sales and Marketing Data: This includes information provided for promotional communications, such as name, email address, and company name.

  • Support Data: When you seek customer support, we collect details like code, text, or multimedia files.

Purposes for processing

We use the Personal Data collected as described in this Privacy Policy, as specified in any agreement that incorporates this Privacy Policy, or as disclosed to you in connection with the Services. We do not carry out any statistical evaluation of a data subject s behaviour (profiling); in particular, there is no automated decision making (see Art. 22 Para. 1 and Para. 4 GDPR and Art. 6 Para. 1(b)GDPR).

We use information held in the following ways:

  • To ensure that content from our Website is presented in the most effective manner for You and for your computer;

  • We use Personal Data for activities like billing, accounting, and compensation. This includes creating aggregated statistical data for internal reporting, financial reporting, revenue planning, capacity planning, and forecast modeling (including product strategy).

  • To carry out our obligations arising from any contracts entered into between You and us; This includes training, consulting, implementation providing technical support, professional planning, advice, guidance, data migration, deployment, and solution/software development services.

  • We may  process registration information related to your attendance at one of our events, including travel information, scheduling information, food preferences or allergies, and accessibility requests in order to meet the expectations.

  • To allow you to participate in interactive features of our service, when you choose to do so.

  • If you contact us via our website, via email or in any other way, we process your Personal Data to understand and respond to your request and to provide customer service. In such circumstances, your request might be internally forwarded to the responsible department at ITC.

  • We will ask for your consent before using information for a purpose other than those set out in this Privacy Policy.

Information you share in public areas of the Website or make visible in the CV and profile database may be accessed, used, and stored by others around the world. We strive to provide a safe environment by attempting to limit access to our database to legitimate users, but we cannot guarantee that unauthorized parties will not gain access. We also cannot control how authorized users store or transfer information You give to us, so you should not post sensitive information to the Website.

We do not sell, trade, or rent the Personal Data collected from our services to third parties.

Recipients

Your Personal Data may be transferred to affiliates and partners of ITC as well as to a limited number of service providers (Processors) that perform processing operations such as database monitoring, hosting services, ticketing or provisioning of software tools. These service providers process Personal Data on our instructions and are legally bound to safeguard the processed data. All Processors have been selected carefully and are closely monitored.

When we ask third parties to host or present at certain events like webinars or training, we may forward your Personal Data to the respective third party who may use this data to provide access to the event or may contact you for related marketing purposes.

Our Services may contain links or buttons that lead to third-party services like LinkedIn. Use of these features may result in data collection. Engaging with these buttons, tools, or content may automatically send certain browser information to these companies. Please review the privacy statements of these companies for more information.

If Personal Data is transferred to subsidiaries, partners service providers or third parties located outside the European Economic Area (EEA) which are not subject to an adequacy decision by the European Commission we will ensure that such recipient offers an adequate level of data protection, for instance by entering into EU Standard Contractual Clauses (SCCs) and implementing additional safeguards in accordance with legal requirements, or we will ask you for your prior individual consent to such international data transfers.

We may disclose your Personal Data to comply with legal requirements, such as in response to a court order or a subpoena. In such an event, we will use all reasonable and lawfully available measures to object to overbroad, unclear or otherwise inappropriate requests for information, and will cooperate with those seeking a protective order unless we are legally prohibited from doing so. We may also share Personal Data with our auditors, attorneys or other advisors under professional obligations of confidentiality in connection with corporate functions.

Duration of data storage

Your Personal Data will be deleted upon your request or as soon as it is no longer required to achieve the purpose for which the Personal Data has been collected, namely, to provide the requested Services. If legal regulations (e.g., by fiscal, commercial, or contractual law) apply that require longer storage of your Personal Data, or if we need your Personal Data to assert legal claims or defend against legal claims, we will store your Personal Data until the expiration of the corresponding storage period or until the settlement of the claims.

Any user account and its related data in applications where we act as Controller will be deleted upon your request or after three years of inactivity

Cross-border transfer of personal information

Wherever nature of business transaction necessitates (For example - offshore services), your personal data can be processed in different countries where ITC affiliates have a office location.  

We oblige data recipient to maintain confidentiality when processing personal data subject to legal confidentiality requirements.  

You have the right to obtain a copy of the safeguards we have put in place for cross-border transfers of your personal information.

Your rights  

You have the following rights in relation to your personal data, depending on the applicable data protection law (for e.g. GDPR, California privacy rights, etc.)

  • Access: You have the right to request information form us as to whether and what personal data we hold

  • Rectification: If any of your details are incorrect, inaccurate or incomplete you can ask us to correct the data

  • Object: You have the right to object to the processing of your data in some circumstances, in particular for direct marketing purposes, for profiling carried out for direct marketing purposes. For other processing done under legitimate interests we will after your objection re-assess the balance between our interests and yours, considering your particular circumstances.  If we have a compelling reason, we may still continue to use your information.

  • Withdraw of consent: You have the right to withdraw consent at any time, provided that our processing is based on your consent.

  • Data portability: In some circumstances you can ask us to send an electronic copy of the Personal Data you have provided to us, either to you or to another organization.

  • Restrict processing: If you are uncertain about the accuracy or our use of your information, you can ask us to stop using your information until your query is resolved.  We will inform you of the outcome before we take any further action in relation to this information.

  • Erasure: You can ask us to delete your Personal Data if deleting your data is not in conflict with our legal and regulatory obligations.  If we are using consent to process your information and you withdraw it, you can ask us to erase your information.
